Leasing Policy
This notice serves as a formal update regarding the leasing policies and enforcement standards for Element Condominium Association, Inc. This communication is issued in accordance with the Association’s governing documents, including the Declaration of Condominium (Section 15 – Leasing, Section 14 – Use Restrictions, and Section 9(c) – Enforcement Authority), as well as applicable rules and Georgia law.
LEASING POLICY OVERVIEW
To preserve the residential character, safety, and security of the community, all leasing activity is strictly regulated.
Owners may not lease or allow occupancy of any Unit without full compliance with Association requirements, including prior written approval and issuance of a valid leasing permit.
RENTAL CAP & LEASING WAITLIST
The Association has reached the maximum allowable number of leased Units under the community rental cap.
As a result:

Any Owner seeking to lease must apply and be placed on the official leasing waitlist.

Leasing approvals will only be granted as capacity becomes available.

Placement on the waitlist does not guarantee approval or timeframe for future leasing.
Units may not be leased, occupied, or made available in any capacity without an approved leasing permit issued by Management.
LEASING WITHOUT A PERMIT IS STRICTLY PROHIBITED
The following actions are strictly prohibited and constitute violations:

Leasing or allowing occupancy without an approved permit.

Executing a lease without prior Association approval.

Listing, advertising, or marketing a Unit for rent without an approved leasing permit (even if no tenant occupies the Unit).

Posting rental listings on any platform, including online marketplaces or social media.
All listing activity alone is considered a violation subject to enforcement.
SHORT-TERM LEASING STRICTLY PROHIBITED
Short-term leasing, transient occupancy, and vacation-style rentals are strictly prohibited within the community.
This includes, but is not limited to:

Airbnb
-
VRBO
-
Booking.com
-
HomeAway
-
Corporate short-term rentals
-
Vacation rentals
-
Executive stays
-
Temporary lodging arrangements

No Unit may be marketed, listed, or used for transient or hotel-style occupancy under any circumstances.
GUEST OCCUPANCY & REGISTRATION REQUIREMENTS
All Units must be used strictly for residential purposes in accordance with the governing documents.
To maintain security and compliance:

Owners are responsible for ensuring all guest activity complies with Association rules.

Unauthorized or unregistered long-term guests may be treated as unauthorized occupants.
LEASING PERMITS & REGISTRATION
All approved leases must be registered with Management prior to tenant occupancy.
Requirements may include:

Leasing permits and written approval.

Administrative fees.
-
Move-in coordination.
-
Lease renewals and updates.
-
Tenant record submission.
Failure to comply will result in enforcement action.
ENFORCEMENT & FINES
The Association enforces all leasing and occupancy violations in accordance with its governing documents.
Short-Term & Leasing Violations

Without a permit: $2,500
-
With a permit: $3,500
-
Subsequent violations: subject to continued doubling and escalation
Each listing, reservation, occupancy period, or violation may be treated separately.
Additional Violations May Include:

Failure to comply with Management requests
-
Unauthorized guests or occupants
-
Unauthorized key fob or access device usage
-
Leasing or listing your unit without permit
-
Parking, noise, or amenity violations
Additional enforcement actions may include fines, suspension of privileges, legal action, and recovery of attorney’s fees.
COMPLIANCE
All Owners, tenants, and occupants are expected to comply fully with these requirements.
