Leasing Policy
Before Any Unit Is Listed for Rent, Please Read Carefully
This Leasing Policy is adopted pursuant to the Element Condominium Association’s Declaration, Bylaws, and Rules & Regulations. Its purpose is to ensure compliance with governing documents, preserve quality of life for residents, and protect the financial stability of the community. All Owners and Tenants are required to comply.
1. Rental Permit Requirement

A valid Rental Permit issued by the Association is required before any unit may be leased.

Rental permits are non-transferable.

Permits are issued only if the Association’s rental cap has not been met.

Units may not be advertised or occupied by tenants without an active rental permit.
2. Rental Cap & Waitlist

If the rental cap is full, Owners may request placement on the Rental Waitlist.

Waitlist placement is granted in the order requests are received.

When a rental slot becomes available, the next Owner on the waitlist will have 30 days to submit all required documentation.

No leasing is permitted while on the waitlist.
3. Lease Requirements
All leases must meet the following requirements:

Minimum lease term of twelve (12) months

Lease must be submitted to Management prior to move-in

Lease must list all occupants and include valid government-issued photo IDs

Lease must include the Association’s Lease Addendum
-
Lease must be executed by the Owner of record and the Tenant
-
Lease must be in favor of an individual, not a corporate entity

Short-term rentals, including but not limited to Airbnb, VRBO, or similar platforms, are strictly prohibited.
4. Tenant Registration & Move-In Requirements
Approved tenants must:

Be registered with Management prior to occupancy

Submit all required forms, including Resident Contact Information and Vehicle Registration

Complete a Move-In/Move-Out request and pay applicable fees and deposits

Participate in a required Resident Orientation with Property Management
5. Owner Responsibilities
Owners leasing their units are fully responsible for:

Tenant behavior and compliance with all governing documents and community policies

Timely submission of lease renewals, amendments, or tenant changes (within 10 days)

Maintaining the unit in accordance with Association standards

Ensuring required insurance coverage is maintained

Violations by tenants, occupants, or guests are the responsibility of the Owner and may result in fines, enforcement action, or suspension of leasing privileges.
6. Enforcement
Failure to comply with this Leasing Policy may result in:

Denial or revocation of rental permits.

Fines in accordance with the Association’s Fine Schedule.

Legal enforcement as permitted by the governing documents and applicable law.

This policy is enforceable against all Owners, Tenants, occupants, and guests. In the event of a conflict, the Declaration, Bylaws, and officially adopted Rules and Regulations shall control.
